Welcome to the MemoWord flashcard app (hereinafter referred to as "the App"), provided by FOP Tikhonova Elena (Ukraine) (hereinafter "MemoWordTeam"). By accessing or using the App, you agree to these Terms of Use and the Privacy Policy. Please review this document carefully before proceeding.

1. Terms of Use

1.1. About the App

MemoWord is a mobile application ("App") designed to simplify the process of adding, organizing, and memorizing lexical materials through flashcards, quizzes, and other learning tools. The App is available on both the App Store and Google Play. Additionally, a Web User Console is available at https://memowordapp.com, allowing users to manage their content seamlessly.

1.2. User Content

Users can add personal words, phrases, notes and flashcard sets ("Content"), download sets from the App's collection, or access sets shared by third parties. By uploading your Content, you confirm that it does not infringe on any third-party rights. MemoWordTeam assumes no responsibility for user-generated Content.

1.3. Premium Features

Certain features, such as premium flashcard sets, an ad-free experience, and enhanced functionality, are available through paid subscriptions ("Premium Subscriptions"). Details on subscription duration, pricing, and payment terms can be found in the "Premium Subscriptions" section of the App settings. MemoWordTeam reserves the right to offer additional paid content, even to users with active Premium Subscriptions.

To explore Premium features, users can take advantage of a 3-day free trial, which allows downloading one set from the collection, adding up to 100 custom flashcards, or uploading a file with personal vocabulary.

Users may need to provide payment information to activate the free trial. MemoWordTeam will not charge users until the trial period ends.

Upon trial expiration, users will be prompted to purchase a Premium Subscription or switch to a limited free version with restricted functionality and content capacity. The free version may include mandatory ads.

Premium subscribers can access the full version of the App on any device linked to their iTunes or Google Play account as long as the subscription remains active. Subscriptions can be canceled, but they will remain effective until the end of the current billing cycle.

By subscribing to auto-renewal, you consent to the automatic renewal of your subscription unless canceled.

Auto-renewal conditions:

• Payments are charged to the user's iTunes or Google Play account upon purchase confirmation.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Renewal charges will be applied to the user's iTunes account within 24 hours prior to the end of the current period.
• Unused portions of free trials are forfeited upon purchasing a subscription.
• Auto-renewal can be disabled via your app store account settings.

Deleting the App from your device does not automatically cancel your subscription. For assistance with subscription management, contact Apple Support or Google Support.

If a subscription lapses, users revert to the limited free version.

MemoWordTeam reserves the right to adjust pricing for existing subscribers.

Refunds for purchases or subscriptions are generally not available unless required by law.

The scope of free and Premium features may vary depending on the user's language profile (base and target language combination). Current details can be found in the "Help & FAQ & Support" section of the App settings.

A one-time lifetime "Forever" Subscription provides indefinite access to Premium features for the App's supported lifespan. Users are not entitled to refunds or compensation if the App is discontinued or removed from the App Store or Google Play.

1.4. Proper Use of the App

Users agree to comply with applicable laws when using the App.

Prohibited activities include:

• Using the App for illegal purposes.
• Attempting unauthorized access to systems.
• Spreading malware or spam through the App.

1.5. Age Restrictions

The App contains no adult content and is suitable for independent use by children. However, the app's interface is primarily designed for older students and adults.

2. Privacy Policy

2.1. Data Collection

We collect the following data:

• Registration details: unique identifiers for user accounts and devices.
• App usage data: user-generated Content, including flashcards, word sets, language profiles, and other materials stored on secure servers.
• Learning statistics, preferences, vocabulary retention status, download country, and interface language.
• Device details: model and operating system.
• For free version users, data such as advertising ID, IP address, and location may also be collected.

2.2. Data Usage

Collected data is used to:

• Ensure App functionality.
• Personalize the user experience.
• Respond to customer support inquiries.
• Improve services.
• Send push notifications. Users can manage notification preferences via device or App settings.
• Inform users about new features, discounts, and promotions. Users may opt out of marketing emails by following unsubscribe instructions or contacting Help@MemoWordApp.com.

2.3. Data Retention

Your data is stored securely and shared with third parties only when necessary:

• For advertising services and analytics within the free version (e.g., sharing advertising ID or IP address with partners).
• To enable App functionality or fulfill user requests (e.g., hosting content or sending notifications).

Data is retained as long as the account remains active or as needed to provide services. We reserve the right to delete user Content if:

1. The user has never purchased a Premium Subscription.
2. The user has not updated Content for over 12 months.

2.4. User Responsibilities

We prioritize the security of your personal information and adhere to industry standards for data protection during transmission and storage. However, no method is entirely secure. For questions regarding data security, contact Help@MemoWordApp.com.

2.5. User Responsibilities

Users are expected to:

• Provide accurate registration information.
• Use the App as intended.
• Respect intellectual property rights.
• Comply with laws when using the App.
• Maintain the confidentiality of account credentials.

MemoWordTeam is not liable for consequences resulting from a failure to meet these obligations.

2.6. User Rights

Users have the right to:

• Access their data.
• Request modifications or deletions.
• Opt out of data usage for marketing.

2.7. Data Deletion

Users can delete their data by:

• Using the in-app account deletion feature.
• Sending a request to Help@MemoWordApp.com. Requests will be processed within 30 days.

2.8. Cookies and Analytical Tools

We use cookies to improve your experience and analyze our traffic. Specifically, we use Google Analytics (GA4) and Google Ads to understand how visitors interact with our website and to measure the effectiveness of our advertising campaigns. These cookies allow us to recognize and count the number of visitors and see how they move around the site.

Your Choice: By clicking "Accept" on our consent banner, you agree to the placement of these cookies. If you click "Decline," no analytical or advertising cookies will be installed. To enhance the user experience, we may request information such as advertising ID, IP address, and location. This data remains on your device and is not collected by us. However, third-party services used by the App may collect identifying information.

3. Limitation of Liability

3.1. Disclaimer of Warranties

MemoWordTeam provides the App "as is" without warranties of any kind, express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement.

3.2. Limitation of Liability

MemoWordTeam is not responsible for:

• Direct, indirect, incidental, or consequential damages arising from the use or inability to use the App.
• Loss of data, revenue, or intangible assets.
• Actions of third parties, including unauthorized account access or data breaches.

3.3. Legal Obligations

Nothing in these Terms excludes or limits liability for losses that cannot be excluded under applicable law.

4. Additional Provisions

4.1. Availability and Accuracy

We continually update our product offerings on the App Store, Google Play, and https://memowordapp.com. However, information may not always be accurate or up-to-date. We reserve the right to correct errors or update information without notice.

4.2. Changes to Terms of Use

We may update these Terms of Use and Privacy Policy to reflect changes in practices or functionality. Users will be notified via email or in-App notices. Regular review of these Terms is recommended.
